The other driver’s insurance will not pay your medical bills as they are incurred. A claim for the cost of your treatment, along with your claim for pain and suffering, is made against the other parties insurance after you have finished treatment. Do not ask your medical providers to bill the other driver’s insurance. When you authorize your medical providers to bill the other party’s insurance, you are giving the other side access to your medical information prematurely and without attorney review.

- held by anyone to whom you are related by blood or marriage; and
- who are living in the same household with you.
You must exhaust all the available PIP coverages before billing your health insurance.

- If the other party is at fault, you should request that their insurer pay for your repair costs. They cannot force you to use any particular repair shop and you should take your car to the best shop in your area.
- If there is a dispute regarding liability, or if the other insurer is simply unresponsive, you can elect to make a claim with your own insurance carrier. Once again, they cannot force you to use any particular repair shop and you should take your car to the best shop in your area. By making a claim with your own company, however, you will be required to pay any deductible on your policy in order to get your car out of the shop. Your insurer will pursue the other driver’s carrier for the repair cost, including the deductible you paid. If they are successful, your insurer is required to reimburse you for the deductible.
